These Terms of Service ("Terms") govern your access to and use of Estimancer's website, web application, and related services (collectively, the "Service"), operated by Estimancer ("Estimancer," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You're responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity that happens under your account.

Subscriptions & Billing

Paid plans are billed in advance on a recurring basis through our payment processor, Stripe. You can cancel anytime from your account settings; cancellation stops future billing but does not refund the current billing period unless required by law. We may change subscription pricing with advance notice.

Acceptable Use

You agree not to use the Service to:

• Violate any law, or the rights of any third party.
• Upload or transmit content you don't have the right to share, or that is fraudulent, deceptive, or infringing.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its underlying systems.
• Use the Service's automated communication features to send unsolicited bulk, spam, or marketing messages to recipients who have not agreed to receive them from you.

Text Messaging Feature — Acceptable Use

Estimancer lets you send estimate links and account-verification codes to a phone number by text message. This feature exists to notify a specific client that a specific estimate is ready, or to verify your own account — not to send bulk, unsolicited, or marketing text messages.

• You may only text a phone number you have a legitimate business relationship with, or that has otherwise agreed to receive a message from you.
• You may not use the feature to send promotional blasts, mass unsolicited outreach, or any message a recipient has not consented to receive.
• You are responsible for your own compliance with the Telephone Consumer Protection Act (TCPA) and other applicable messaging laws with respect to messages you choose to send through the Service.
• We may suspend or terminate access to the text messaging feature, or your account, for violations of this section.

Your Content

You retain ownership of the job descriptions, photos, client information, and other content you submit to the Service ("Your Content"). You grant Estimancer a license to use Your Content solely to operate the Service — including processing it with AI to generate estimates on your behalf. Estimates are generated by AI based on the information you provide; you're responsible for reviewing an estimate for accuracy before sending it to a client.

Intellectual Property

The Service, including its software, design, and branding, is owned by Estimancer and protected by intellectual property law. These Terms don't grant you any rights to our intellectual property beyond what's needed to use the Service as intended.

Disclaimers

The Service, including AI-generated estimate content, is provided "as is" without warranties of any kind. Estimancer does not guarantee that AI-generated estimates are complete, accurate, or suitable for any particular job — you are responsible for reviewing and approving any estimate before it's sent to a client.

Limitation of Liability

To the maximum extent permitted by law, Estimancer will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including losses related to an inaccurate estimate or a message sent through the Service.

Termination

You may stop using the Service and cancel your account at any time. We may suspend or terminate your access if you violate these Terms, including the acceptable-use provisions above.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you directly.

Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
